But, good lord, they then strip him of his state-issued permissions slip to carry arms, and confiscate his property (arms), then refuse to provide him a copy of the police report?

Deprivation of civil liberties. Theft of property. Disregard of the normal and customary operation of the public's business by public officials. "Red Flag" seizure laws can absolutely be abused. This situation, if as reported, sure seems a classic example.

Lawsuit, anyone? Would love to see SAF/GOA/NRA get involved with this one, and for them to shove it all the way to SCOTUS for consideration (if those folks would bother to hear such a case, that is).

Gotta love "progressive" thought, eh?

The guy that lost his guns was not the one that was leaving his post. That person was the School Resource Officer.

The guy that lost his guns was the Crossing Guard that was having a private conversation with a friend at a diner and spoke about what could happen when the SRO leaves his post daily to get a Coffee at a local place down the road. The waitress overheard the conversation and assumed that they were talking about shooting up the school so she reported it.

The Police over reacted and stripped the guy of his guns even though no threat had been made.

This is when you see the door to the car come open and just before that occurred, the shooters body language had already become stiff and pointedly animated. The lady who left the store unnaturally looks over her left shoulder as if she heard something in the direction of the shooter and the fellow that exited his car was holding the front door open while staring directly at the shooter rather than his ladyfriend who was with him. What this looks like is a verbal confrontation which was initiated by the shooter. I will speculate that it was likely loud, in that one or the other participant was probably speaking in raised tones. I say that based only on what I can see in the video, I have not come to know anything about the actual trial.
So the lady in the car feels threatened by the man talking to her yet she is going to open the door and get out to continue allowing him to make her feel threatened but up closer?

A person that is "feeling threatened" would, by all logic, roll up their window and lock the door, not attempt to get out wouldn't you think?

This tells me that the person in the vehicle is likely escalating the discussion to a higher level because they were offended the man had the audacity to point out that they were in a handicapped space.

Then, the boyfriend comes out of the store and sees this white man and his girlfriend talking and realizes that whatever is being said, this guy is upsetting his girlfriend so he must beat his .

The boyfriend then knocks the man to the ground and circles him as if to line up to punt.

The guy on the ground, not wanting his head stomped on, draws and shoots.

Seems to me that the girlfriend in the car and the boyfriend that did the grand slam were the ones that escalated what was seemingly a simple conversation pointing out that they had parked in a reserved spot. "

RScottie created the thread 84-Year-Old Korean War Veteran / School Crossing Guard Fired, Guns Taken.
" "Tisbury, Mass — A Tisbury School crossing guard was recently “relieved from duty” and has had his personal guns confiscated.

The man allegedly made threats to the school in the hearing of a waitress at Linda Jean’s restaurant in Oak Bluff.

But while the headline sounds ominous, the facts make the accusation laughable.

Stephen Nichols, 84, is a 60-year veteran of the Tisbury Police Department.

He’s also a veteran of the Korean War, a retired constable He’s served as a crossing guard for years and is beloved in the community.

What would make a man like this make a violent threat against the school children he had been protecting — in one form or another — for six decades?

Well, simply put, he didn’t."

As you point out, the trouble is that ~6ft is almost instantaneously covered by an athletic person. Barring the means of disallowing the guy a second shot at him, there was zip keeping the guy from doing it.

I suspect the logic of the jury "tripped" on the one step to the right/rear that the shover showed on video. I suspect they took that to equal withdrawal. Combined with having no apparent man-made tools in his hands, that sealed it for them. Disregarding the fact that ~6ft can be covered in a flash, of course.

Might have been better served with loudly commanding the guy to go prone, while getting up and backing up somewhat, to await arrival of police to cope with it. And, under those circumstances, if the shover had then attempted a second violent assault, the guy would have had vastly greater cause to fire upon the shover in order to repel what was about to be a no-holds-barred attempt to swipe (and likely use) his firearm against him.

Food for thought, for all of us.
If the man that was attacked and shoved to the ground had been a police officer and everything else had been the same, would they have convicted a Police Officer? "

I am just going by what Mark Levin and many more Constitutional Experts have said and that is, until there is a vote or bill passed to start Impeachment proceedings, no impeachment proceedings exist thus there can be no subpoena's in regards to impeachment.

Once it is voted on and there is an official impeachment process going on, then BOTH sides have subpoena powers. As it is now, the House is claiming only they can subpoena witnesses and the Executive Branch is not allowed to attend the hearings, cross examine them, or even talk to them.

That is why it must be voted on. "

Once was, folks could have a civil, even if pointed, discussion with someone without expecting to get violently thrown to the ground by a non-involved third party. That time is long gone.

Of course, THAT choice was irrelevant, so far as the situation legal indictment was concerned. It was the guy's necessity based on the reasonableness standard in the law. Unarmed and somewhat distant, apparently "turning away" (or, at least turned away) seems to have meant non-threat to the jury. Despite the pain of the knock-down, and despite 6ft being a trivial distance for an otherwise strong and athletic person to cover. Had the guy moved on the downed man, I doubt that even if firing multiple times on the instant of the charge he'd have been capable of halting that hypothetical attack. Not from ~6ft away.

Anyway, the jury found it wasn't sufficient to justify halting.

Might be interesting to imagine what if the guy had been standing (instead of remaining on the ground), in which case he could have retreated and gave at least some evidence of not wanting engagement ... despite how the earlier discussion might have begun. Not that it matters much. Despite FLA not being a "duty to retreat" state. Such distinctions in the guy's choices might well have been the difference between his acquittal and conviction.
I guess you have to let the attacker start ground pounding you, perhaps getting your teeth kicked in first?

At bare minimum, in Florida it seems, you must let the attack progress a bit and hope you are not seriously injured before you are allowed to defend yourself? This is true even if you have already been attacked it seems.

What a shame considering how many cases here lately have resulted in one punch deaths either from the punch or the head hitting the sidewalk.

We must hope that our attacker is gentle with his initial blows I guess? "

" I just got back from the longest bike ride I have taken, 891 miles. No, not on a bicycle, on my VTX1300c.

I rode south out of Kentucky, went through the Cumberland Gap, over to Tennessee and stopped to see an Air Force buddy I had not saw in 20+ years. It was a great time and seemed like it had not been that long and we vowed to get together more often. He rides too and we did a short run around his area while there.

I continued on and went around the west side of the Smoky Mountains National Park and entered the Tail of the Dragon from the west.

Attachment 25282

After the Dragon, I continued on the Moonshiner 28 over to 23 and went south to Sky Valley Georgia. There I went to the condo my mom has for a visit.

I stayed a couple of days with my mom and her friend and we explored the area in her car. She would not ride the motorcycle.

The return trip was a little different as I went right up through Cherokee in to the park, went to the observatory and mainly enjoyed the views.

I am already planning my next trip!

Below is a picture of me making up with the Dragon. I am carrying, can you see it?

RScottie created the thread He Went Shooting With His Mom. Now He Can’t Return To School.
" A Colorado teen has been told he cannot return to school until authorities hold a “threat assessment hearing” after he went target shooting with his mother. Nate Evans, a junior at Loveland High School in Loveland, Colorado actually got a visit from police after he posted video of his plinking with his mom Justine according to the Colorado 2nd Amendment group Rally For Our Rights.

A report had come in to the police department about the video and they were told Nate was a threat. After showing the videos to the police officers and explaining that they’d simply gone on a mother-son outing to train with their legally owned firearms, the police stated that they had done nothing illegal and were well within their rights. They also determined Nate was not a threat to himself or anyone else, and went on their way.

But it wasn’t over.

RScottie created the thread Update on my Daughter and her recovery.
" I am happy to report that my daughter is recovering pretty well. She is still very sore and has limited motion.

She has returned to school and that has really helped her emotionally.

I on the other hand am still feeling the fallout from this.

We are starting to get bills for her hospital stay, the surgeries, and her aftercare. All totaled, they billed my insurance almost $200,000 so far. My insurance says they will go after the drivers insurance policy for me.

That is all well and good but I have 80/20 coverage and they are sending me the bills for the 20%.

I have called a lawyer as 20% could be as much as $40,000.

I don't have that.

I have been riding my motorcycle a lot and just trying to keep my sanity.

I have a lot to be thankful for, especially that my daughter even survived. But, this is likely going to go on for some time. I cannot let it bankrupt my family.

If anyone has been through something similar, advice is appreciated.

RScottie created the thread Spent last week at the hospital, my daughter was in a bad wreck.
" I haven't been keeping up with the posts the last week and a half because my 17 year old daughter was in an accident.

She was a passenger in the truck pictured below. She was in the backseat and had her seat belt on.

There were 5 teens in the truck. All of them were injured.

My daughter was the most seriously injured. She suffered internal bleeding that required surgery and the removal of two pieces of her small intestine.

She also had a broken back and the top of her sternum, the manubrium, was broken. She was bruised all over.

Her back required 4 screws and two rods to repair. She will have those for life.

She is out of the hospital now and was able to return to school today. She has a long way to go to recover, but she is strong.

The driver's right leg was broken in 4 places and his liver and spleen were lacerated. The did not do surgery on them as they stopped bleeding on their own.

Another one had a broken jaw and numerous bruises while the remaining two were just bruised all over, and sore.

I hope those kids realize how close they came to not going home that day. I have been thanking God daily for her recovery.
